Subsequent Probation Bill passes House and Senate, heads to Governor

Earlier today (4-5-18) the Senate and House both unanimously passed an amended version of SB2443. This legislation as amended restores subsequent probation for preferred service state employees who accept another preferred service position within the same state agency. SB2443/HB2589 was sponsored by Sen. Frank Niceley and Rep. Timothy Hill and is part of TSEA’s legislative agenda.


About the bill as amended:
This legislation as amended restores subsequent probation for employees in the preferred service who accept another preferred service position within the same state agency. Under this legislation, an employee serving a subsequent probationary period may appeal a suspension, demotion, or separation from service; provided, that an employee shall not appeal a demotion that returns the employee to the employee’s immediately preceding former position. Affected employees shall serve subsequent probation for a time period of not less than one (1) year.

Reason for legislation:
State employees who have given years of service to our state deserve security. An employee with 15 years of service should not be punished for being rewarded, having their title changed or laterally moving within the same agency. This bill will help with recruiting, retaining, and rewarding as is the intent of the TEAM Act.
