SB1873/HB2540 Update: Bill Fails for 2026 Session
SB1873/HB2540, despite passing the Senate on April 16, failed during the April 21 meeting of the TN House by a vote of 42 – Yes, 40 – No, and 4 Present-not-voting, which is short of the constitutional minimum of 50 required for passage in the House. The bill was referred back to the Calendar & Rules Committee.
The bill was not rescheduled in the House, and on Thursday evening April 23, the legislature adjourned sine die. This means they have officially concluded their business for the 2026 session and the bill can no longer be voted on this session.
As a result, current law remains in place, including the existing 3-step appeals process and all related protections.
While the legislation may be brought back in a future session, it is no longer active for 2026.
